These SickKids Foundation Content Creator Terms and Conditions apply to all those who livestream, create long or short-form videos, create static imagery, or otherwise create web-based content ("Content") to fundraise online on behalf of SickKids Foundation ("SKF Content Creators"). Online fundraising events organized by SKF Content Creators to raise money for SickKids Foundation are referred to below as "Events". "SickKids Foundation" refers to the Hospital for Sick Children Foundation.
- I acknowledge that any expenses I incur in creating Content or hosting an Event are my responsibility and that SickKids Foundation is not responsible for any losses that I may incur in creating Content or hosting an Event.
- I understand that SickKids Foundation will handle all tax receipting in accordance with its tax receipting policy and the guidelines set by the Canada Revenue Agency. Eligible donors may receive a tax receipt if they provide their name and address to SickKids Foundation and they meet SickKids Foundation's minimum donation threshold for tax receipting purposes. I agree to direct any questions about tax receipting from donors or prospective donors to SickKids Foundation.
- "SickKids", "SickKids Foundation", "The Hospital For Sick Children", "The Hospital for Sick Children Foundation", "In Support of SickKids Foundation", "Create4SickKids"1 and "C4SK"2 and related logos are trade-marks of SickKids Foundation and The Hospital For Sick Children. I understand that any usage of such trade-marks is subject to the approval of SickKids Foundation and The Hospital For Sick Children, in their sole discretion. I understand that Content and promotional materials must not imply that SickKids Foundation or The Hospital for Sick Children are involved in any Event as anything other than beneficiaries of the proceeds.
- SickKids Foundation's registered charity business number cannot be used without the prior written approval of SickKids Foundation for each and every use.
- I acknowledge that my participation in the Content Creator Fundraising Program does not make me an employee or agent of SickKids Foundation and that I am not entitled to any benefits or compensation from SickKids Foundation in accordance with this program. If I am an existing employee of SickKids Foundation, I acknowledge that no additional compensation will be provided to me for participating in the Content Creator Fundraising Program to promote or benefit the Foundation. I understand that the opportunity to use SickKids Foundation's name, trade-marks and logos, as set out above, is good and adequate consideration for the obligations set out in these Content Creator Terms and Conditions.
- I acknowledge that I am not a representative of SickKids Foundation or the Hospital for Sick Children and I am not authorized to take any action or communicate on behalf of SickKids Foundation or the Hospital for Sick Children. Any requests for comment by SickKids Foundation should be forwarded to create@sickkidsfoundation.com
- I acknowledge and agree that The Hospital for Sick Children Foundation and The Hospital for Sick Children, their employees, directors, officers, members, agents, successors or assigns (collectively the "Indemnified Parties"), shall not be held liable for any injury, loss or damage, however caused, which the Indemnified Parties may incur resulting from or arising out of my Content or my Event(s).
- I further agree that I will from time to time and at all times hereafter jointly and severally hold harmless and fully indemnify the Indemnified Parties from any and all actions, causes of actions, claims and demands whatsoever which may be brought against or made upon the Indemnified Parties and against all loss, liability, judgements, costs or expenses which the Indemnified Parties may sustain, incur or be put to resulting from or arising out of any act or omission on my part or of my servants, agents, successors or assigns which was done, or purported to have been done, in connection with the Content or the Event(s).
- I agree that any Content I create, and any Event that I run, shall be created or conducted in a safe manner and to adhere to all federal, provincial, and municipal laws, including without limitation any and all applicable public health guidelines and measures regarding the prevention and mitigation of spreading infectious diseases such as COVID-19. I will obtain all necessary permits and licenses for my Event.
- I agree that in creating Content and conducting any Event, I will comply with all applicable policies and terms of use of Tiltify Inc. (and any other platform used in connection with my Content or Event), and that my Content and Event will not include profanity, sexually explicit content, or anything that SickKids Foundation, in its sole discretion, deems offensive to the moral standard of the community or which it believes negatively reflects on the character, integrity or standing of any organization or individual. I also agree that my Content and Events will not involve any lobbying or advocacy activities.
- I acknowledge that SickKids Foundation is unable to share its donor list or to supply media contacts to help me promote my Content or any Event.
- I acknowledge that, as a general rule, donations to SickKids Foundation shall be used to support SickKids Foundation's highest priority needs, and I will clearly communicate this to donors. Any request to designate a gift for a specific purpose must be approved by SickKids Foundation in advance of my Event; and if approved, must be clearly communicated to all Event participants in advance of the Event.
- These Content Creator Terms and Conditions shall, for all purposes, be construed in accordance with the laws in force in the Province of Ontario and the laws of Canada applicable in Ontario, to the complete exclusion of conflict of laws rules. The parties hereby attorn to the exclusive jurisdiction of courts located in Toronto, Ontario.
- These Content Creator Terms and Conditions are in addition to the applicable policies of SickKids Foundation and to the Terms of Use on the SickKids Foundation website. Please note that the Foundation reserves the right, at its discretion, to change, modify, add, or remove portions of its policies or Terms of Use or these Content Creator Terms and Conditions. Changes to the Content Creator Terms and Conditions will be posted on the SickKids Foundation website. Please check https://www.sickkidsfoundation.com/events/eventtermsandconditions periodically for changes.
- These Content Creator Terms and Conditions are binding upon and shall be to the benefit of the parties and to their respective heirs, administrators, legal personal representatives, successors and permitted assigns.
By clicking the 'I agree…" check box to agree to these Terms and Conditions when prompted, I confirm that one of the following applies:
- (1) I am at least 18 years of age and I have read, understand and agree to the Content Creator Terms and Conditions outlined above;
- (2) I am the parent or guardian of a minor under the age of 18, and on behalf of myself and the minor, I have read, understand and agree to the Content Creator Terms and Conditions outlined above; OR
- (3) I am signing on behalf of a corporation, and I represent and warrant that I have read, understand and agree to the Content Creator Terms and Conditions outlined above and that I have the authority to bind the corporation.
